NULLITY

A nullity (formerly called annulment) declares that the marriage never existed. It has the effect of restoring the parties to single status and provides for orders regarding children, support, and property. If granted, a judgment of nullity permits you to remarry immediately after the court hearing.

The ground for nullity are more complicated than for dissolution, and courts tend to be stricter in requiring that grounds be proven in these cases.

The grounds, as stated in the California Family Code are:

Fraud or force.
Physical or mental incapacity.
Incestuous or bigamous marriage.
One of the spouses was not legally old enough to marry.

4 EASY AND CONVENIENT STEPS

STEP ONE: COMPLETE AN INTAKE ONLINE AND SAVE IT TO YOUR ACCOUNT. Simply answer a set of general questions needed in preparation of your documents. Provide us with a statement in your own words supporting the documents. The online module will guide you through this process.

STEP TWO: PREP XPRESS CHECKS YOUR DOCUMENTS THOROUGHLY AND PREPARES THEM FOR YOUR SIGNATURE. Once you are done with the intake, Prep Xpress does a thorough review of the data provided. We prepare the documents and forward the documents back to you for review and approval.

STEP THREE: SIGN THE DOCUMENTS AND FAX THEM BACK TO PREP XPRESS FOR COURT FILING. After you review the documents to ensure accuracy, print them out and sign them. We then need you to fax or e-mail the signature pages back to Prep Xpress for Court filing.

STEP FOUR: FILED DOCUMENTS. Prep Xpress will file your documents at the appropriate Court. Once your documents are filed with the appropriate Court, Prep Xpress will send you confirmation of the Court Filing.
