NULLITY
 
A nullity (formerly called annulment) declares that the marriage never existed. It has the effect of restoring the parties to single status and provides for orders regarding children, support, and property. If granted, a judgment of nullity permits you to remarry immediately after the court hearing.
 
The ground for nullity are more complicated than for dissolution, and courts tend to be stricter in requiring that grounds be proven in these cases.
 
The grounds, as stated in the California Family Code are:
 
  1. Fraud or force.
  2. Physical or mental incapacity.
  3. Incestuous or bigamous marriage.
  4. One of the spouses was not legally old enough to marry.
